Terms of Service

1. Overview

These Terms of Service (“Terms”) govern access to and use of the Crawlbyte platform, APIs, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Crawlbyte.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. The Service is intended for business and professional use only.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Crawlbyte reserves the right to suspend or terminate any account found to be misused, fraudulent, or in violation of these Terms.

4. Services and Credits

Crawlbyte operates on a credit-based system. Credits are consumed when executing scraping or data-related tasks via the dashboard or API. Credits and subscriptions are non-refundable, purchased credits expire according to your selected plan, and monthly subscription users receive recurring credits with potential bonuses depending on plan type. Crawlbyte may modify features, credit pricing, or limits at any time with reasonable notice.

5. Acceptable Use Policy

You agree to use Crawlbyte only for lawful purposes and in compliance with applicable laws and regulations. Strictly prohibited actions include scraping websites where such actions are explicitly prohibited by law or site terms, collecting or processing personal data without legal basis, attempting to disrupt systems, or reselling access. Violating this policy results in immediate termination without refund or reinstatement.

User Responsibility: You are solely responsible for ensuring that your use of Crawlbyte complies with all applicable laws, regulations, and third-party terms of service. While Crawlbyte implements automated blocking mechanisms for certain websites and prohibited content, these protections are not exhaustive and do not absolve you of your legal obligations. The ability to execute a scraping request through our Service does not constitute legal permission, endorsement, or guarantee of lawfulness for your specific use case. You must independently verify the legality of all scraping activities.

6. Service Availability and Performance

Crawlbyte is provided on an “as-is” and “as-available” basis. We make reasonable efforts to ensure uptime but do not guarantee uninterrupted access or accuracy. We are not responsible for downtime caused by third-party providers or force majeure events.

7. Export Control and Sanctions

You agree not to use or access the Service if you are located in, under the control of, or a resident of any country subject to U.S. embargoes or sanctions. Crawlbyte complies with applicable export control and sanctions laws and may restrict access to users or entities subject to such regulations.

8. Data Handling and Privacy

Crawlbyte processes task data only for service execution. We do not sell or share customer data with unrelated parties. Users retain ownership of data results generated through the Service, while Crawlbyte may store anonymized data for analytics, debugging, or performance improvement. 9. API and Automation Access

API users must keep their keys secure, avoid abusive request rates, and comply with applicable laws. Crawlbyte may revoke access at any time in case of abuse or ToS violations.

10. Payments, Taxes, and Billing

Payments are processed through authorized providers. Fees are non-refundable except where required by law. Applicable taxes, including VAT, are automatically calculated and charged where required. Crawlbyte may suspend accounts involved in disputes, chargebacks, or fraud.

11. Beta and Experimental Features

Crawlbyte may provide beta or experimental features for testing purposes. Such features are offered “as-is” without warranties and may change or be discontinued without notice.

12. Suspension and Termination

Crawlbyte may suspend or terminate your account for violating these Terms or applicable law, misuse, or activity harmful to our systems. Users may submit one appeal to [email protected]. Upon termination, all data and unused credits are lost. Data is deleted within 30 days of termination.

13. Intellectual Property

All Crawlbyte software, designs, and documentation are intellectual property of Crawlbyte Inc. You may not copy, modify, or reverse engineer any part of the Service.

14. Disclaimer of Warranties

The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Crawlbyte does not guarantee the legality, reliability, or completeness of data obtained through the Service. Crawlbyte makes no representation or warranty that any scraping activity performed through the Service is lawful or permissible for your specific use case, jurisdiction, or circumstances. Our automated content filtering and site blocking mechanisms are provided as a courtesy and convenience only, and do not constitute legal advice or a guarantee of compliance.

15. Limitation of Liability

To the maximum extent permitted by law, Crawlbyte Inc. and its affiliates shall not be liable for indirect, consequential, or punitive damages, including data loss or profit loss arising from the use of the Service.

16. Indemnification

You agree to indemnify and hold harmless Crawlbyte from any claims or damages arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

17. Force Majeure

Crawlbyte shall not be liable for any delay or failure to perform due to causes beyond its control, including natural disasters, war, strikes, internet outages, or government actions.

18. Modifications

Crawlbyte may update these Terms periodically. Continued use after changes constitutes acceptance of the new Terms. The latest version will always be available on our website.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved exclusively in the courts of Sheridan County, Wyoming.

20. Language

These Terms are written in English and govern all uses of the Service. Translations are for convenience only; the English version prevails.
